Arbitration-the process and arbitral awards: reflection on the case law of courts.

On April 09. 2019, the main partner of our law firm, Prof. Alexander J. Bělohlávek, moderated an all-day professional conference organized by the Academy of Justice of the Czech Republic and the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic, on the topic of Arbitration-the process and arbitral awards: reflection on the case law of courts. Judges and Arbitrators attended the event. The conference, which was a continuation of a similar event that took place in the spring of 2018, in Prague, under the same format, and also moderated by Prof. Bělohlávek, took place with the support of the Constitutional Court of the Czech Republic, the Supreme Court of the Czech Republic, the Municipal Court in Prague, the Regional Court in Prague and a number of other Czech courts. This successful event was opened by: the President of the Constitutional Court of the Czech Republic, JUDr. Pavel Rychetsky, the Vice-President of the Supreme Court of the Czech Republic, JUDr. Roman Fiala, the President of the Regional Court in Prague, JUDr. Ľjubomír Drápal, President of the Municipal Court in Prague, JUDr. Libor Vávra, and the President of the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic, Prof. JUDr. Marie Karfíková, CSc. Prof. JUDr. Naděžda Rozehnalová, CSc. and Prof. JUDr. Květoslav Růžička, CSc. were co-moderators of the conference. Three key issues related to arbitration were discussed, namely: i) party autonomy in arbitration (in the arbitration agreement and in relation to the arbitral procedure), ii) standards for evidence, and iii) the obligation of arbitrators to instruct.
